A7. 「초중등교육법 시행령」에 따라 외국인인 아동 또는 학생은 학교에 입학을 신청할 수 있고, 학교의 장은 출입국 관련 내용을 확인하여야 합니다. 하지만 학생의 보호자가 확인에 동의하지 않는 경우에는 외국인등록증이 없어도 임대차계약서, 거주사실에 대한 인우보증서 등의 문서를 통해 거주사실을 확인할 수만 있다면 입학을 허가할 수 있습니다. 그리고 교육공무원은 「출입국관리법 시행령」에 따라 통보의무가 면제되므로 미등록 이주아동의 신상정보를 알게 되더라도 출입국.외국인관서에 이 사실을 알리지 않아도 됩니다.
A1. 장기 체류자격을 재외공관에서 받고 입국한 외국인은 입국일로부터 90일 이내에, 국내에서 체류자격부여 또는 체류자격 변경허가를 받은 외국인은 허가를 받은 때에 각 거주지 관할 출입국관리사무소 또는 출장소에 외국인등록 신청 및 접수하여야 합니다.

A3. 체류지를 변경한 때에는 변경한 날로부터 14일 이내에 체류지변경신고서에 외국인등록증 및 체류지 입증서류를 첨부하여 신 체류지의 시.군.구나 신 체류지를 관할하는 출입국관리사무소 또는 출장소에 전입신고을 해야 합니다. 계약서상의 계약자가 본인이 아닐 경우 계약 당사자의 확인서를 가지고 가야 합니다. 체류지 변경신고를 마치면 담당 공무원이 외국인등록증의 뒷면에 변경사항을 기재한 후 체류지 변경 신고필인을 찍어 신고인에게 교부합니다. 체류지 변경 기한 내에 신고하지 않을 경우 범칙금이 부과되니 주의하시기 바랍니다.
A4. 이전에 허가받은 체류기간을 초과하여 계속 대한민국에 체류하고자 하는 외국인은 체류기간 연장허가를 받아야 합니다. 체류기간연장을 신청하려고 하는 외국인은 현재의 체류기간이 만료하기 전 4개월부터 만료 당일까지 신청하여야 합니다. 체류기간만료일이 지난 후 체류기간연장허가를 신청하게 되면 범칙금이 부과됩니다(「출입국관리법」 제 25조). 본인 또는 대리인〔국민의 배우자(F-6)등 대리인이 불가능한 자격이 있으니 사전 확인 필요〕이 주소지 관할 출입국관리사무소에 체류연장허가 신청서와 각 체류자격 별로 필요한 제출서류를 준비하여 신청하면 됩니다.
A5. 「재한외국인 처우 기본법」상 ‘결혼이민자’, 즉 대한민국 국민과 혼인한 적이 있거나 혼인관계에 있는 재한외국인에 해당하는 혼인이주민과 한국국적자(귀화 등 포함)로 이루어진 가족이라면 다문화가족에 해당합니다. 따라서 (1) 단독가구로서 혼인이주민 1인이 다문화가족이 되지는 않습니다. (2) 이혼한 혼인이주민과 한국 국적의 자녀로 이루어진 가족은 다문화가족에 해당합니다. (3) 이혼한 혼인이주민과 외국 국적의 자녀로 이루어진 가족은 다문화가족에 해당하지 않습니다.

A6. 혼인 후 한국에 거주하다가 자신의 책임이 없는 사유로 이혼하게 된 경우, 혼인 이후 한국에 산 기간이 2년이 넘으면 계속 거주요건을 충족하여 귀화 신청을 할 수 있습니다.

A8. 난민인정자의 경우, 「난민법」에 의해 「국민기초생활보장법」상의 급여를 신청할 수 있으므로 「국민기초생활보장법」 제7조의 교육급여 등을 신청할 수 있습니다. 하지만 다른 체류자격을 가진 이주아동의 경우 국가에서 제공하는 지원제도에 포함되지 않는 경우가 많습니다. 특히 체류자격이 없는 미등록 이주아동은 스쿨뱅킹 계좌의 개설, 학교 홈페이지 및 교육사이트의 가입, 체험학습을 위한 보험가입, 각종 대회 참가 등 사회서비스와 교육 서비스에서 소외되기도 합니다. 이러한 요소들은 이주아동의 공교육 이탈을 부추기는 주요 원인으로 작용합니다.
A9. 체류자격을 가지지 못한 미등록 이주노동자의 경우에도 노동자로서의 권리를 보장 받을 수 있습니다. 노동을 제공한 것은 체류자격의 유무와는 관계없이 변치 않는 사실이기 때문입니다. 따라서 미등록 이주노동자도 「근로기준법」, 「산업재해보상보험」등 노동법의 적용 대상이 됩니다.
A10. 임금체불로 사업장 변경이 가능하려면 월 임금의 30% 이상의 금액을 2개월 이상 지급하지 않거나 지연하여 지급한 경우, 월 임금의 10% 이상의 금액을 4개월 이상 지급하지 않거나 지연하여 지급한 경우 「최저임금법」에 따른 최저임금액에 미달하여 지급한 경우 중 하나에 해당되어야 합니다. 이를 입증하기 위해서 근로계약서뿐 아니라 급여명세서나 임금 지급 계좌의 임금 입금내역 등을 잘 보관하고, 근로시간도 꼼꼼하게 기록해 두는 것이 좋습니다. 신청 기한은 체불 또는 지급 지연 중이거나, 체불 또는 지급 지연이 종료된 날로부터 4개월 내입니다.
